Zoning Ordinances
Gazebos, screen houses, and children’s playhouses (swing sets, slides, and sandboxes are not considered children's play structures) are listed in the city’s zoning ordinances as an accessory structure. These types of structures are allowed by right in all Residential Zoning districts and Residential Uses of Commercial and Industrial Zoning Districts. These types of structures may also be allowed in certain Nonresidential Zoning Districts but only if approved as a conditional use. They are required to comply with the requirements set forth in the Zoning Code regardless whether or not the structure rests upon a foundation.
Requirements
Where allowed, only 1 gazebo, screen house or children’s play structure is permitted per lot.
The maximum allowed height is 15 feet measured to the top of the highest wall.
The structures may not be located within any easements.
These structures shall not be used for storage.
These structures shall not be constructed out of materials that would constitute a nuisance.
Check with the Dane County Register of Deeds office for deed or plat restrictions prior to construction.
Electrical, Plumbing or HVAC permits would be required if these elements are installed.
Building permits are required for the construction of gazebos and screen houses, but are not required for construction of a play structure.
